The Law Today: Civil First, Criminal Only for Bad Faith

Since the reform of the Commercial Transactions Law, a cheque returned for insufficient funds is no longer a crime in the ordinary case. Instead, the dishonoured cheque itself became an executory instrument: the holder can take it straight to the execution court and enforce the unpaid amount without filing a full lawsuit first.
