An unpaid invoice is not just an accounting problem. Every month a debt ages, the debtor’s assets move, limitation periods run, and your leverage shrinks. The UAE gives creditors unusually fast recovery tools — payment orders decided on documents, cheques enforceable directly through the execution court, attachment of bank accounts — but they reward creditors who act quickly and correctly.
KH Legal’s debt recovery team acts for companies, landlords and individuals recovering debts across the UAE, and for debtors who need protection from unlawful collection pressure.
How We Recover Debts
Amicable stage — the lawyer’s letter. A significant share of debts are paid within weeks of a properly framed legal demand, because it signals that court action is genuinely next. We combine the demand with a settlement structure where the debtor’s position makes staged payment more realistic than a judgment they cannot satisfy.
Payment orders. For debts evidenced in writing — contracts, invoices, account statements, acknowledgments — the payment order procedure delivers an enforceable order in days to weeks, without a full trial. It is the sharpest tool in UAE debt recovery and our default route whenever the paperwork supports it.
Cheque enforcement. A dishonoured cheque is an executory instrument: we file it directly with the execution court and move to attachment without a substantive lawsuit. Where a cheque was given as security, we handle the substantive challenges that regime allows — on either side.
Substantive claims and arbitration. Where the debt is disputed, we litigate — with court-appointed accounting experts reconciling the accounts — or arbitrate where the contract requires it.
Execution and asset tracing. A judgment is only worth what it recovers. We pursue bank account attachments, seizure of vehicles and property, travel bans where legally available, and enforcement against guarantors.
Cross-border recovery. For foreign creditors pursuing UAE debtors — and UAE creditors pursuing assets abroad — we manage recognition, enforcement and coordination with counsel in other jurisdictions.
What It Costs
We are direct about economics because debt recovery must make commercial sense:
- Fixed fees for demand letters and straightforward payment-order files
- Staged fees for litigation, agreed before each stage begins
- Success-fee components in suitable commercial recovery mandates
- Court fees in the UAE are generally a percentage of the claim, capped — we set out the full cost picture before you commit
If a Collector Is Pursuing You
Debt collection has legal limits. Threats, harassment, contacting your employer, or publicizing your debt can constitute offences under the Penal Code and Cybercrimes Law — and only courts impose travel bans or arrest, not collection agencies. We defend debtors against unlawful pressure, negotiate structured settlements, and litigate genuinely disputed claims. A debt does not strip you of your rights.
Frequently Asked Questions
How long does debt recovery take in the UAE?
A payment order can be issued within days to weeks of filing; execution measures like bank attachments follow quickly. Contested substantive cases typically run months. The biggest variable is usually the quality of your documents.
What documents do I need to recover a debt?
The contract or purchase orders, invoices, delivery records, account statements, any acknowledgment of the debt, and proof of demand. Signed acknowledgments and cheques are the strongest foundations; we assess what you have for free before filing.
Is a bounced cheque still a criminal matter?
Mostly no — since 2022 it is primarily enforced as a civil execution matter, which is faster for creditors in practice. Criminal liability survives for bad-faith conduct such as closing the account before presentation.
Can I recover a debt from a company that is closing down?
Yes, but speed is critical: creditor claims must be lodged within liquidation deadlines, and directors or partners can bear liability in defined situations. If you hear a debtor is liquidating, act the same week.
Is there a deadline for filing debt claims?
Yes — limitation periods apply, generally up to ten years for written commercial obligations but far shorter for cheques and specific claim types. Every month of delay is legal risk.
