When a brand becomes well known, imitators follow. Counterfeit products bearing the registered trademark of one of the UAE’s recognised companies began appearing in the local market, damaging the brand’s reputation, misleading consumers and taking sales from the genuine product.
KH Legal lawyer Mouaz Al-Khatib took on the brand-protection mandate and pursued it through the administrative enforcement route before the UAE Ministry of Economy and Tourism. In several cases, his complaints resulted in action against the traders concerned and in fines for dealing in goods bearing forged trademarks. Further cases for the same client are in progress.
Our approach
- Evidence first: each case was built on the client’s registered trademark rights and documented evidence of the infringing goods.
- The administrative route: complaints were filed with the Ministry of Economy and Tourism under the UAE Trademarks Law (Federal Decree-Law No. 36 of 2021) and the law on combating commercial fraud (Federal Decree-Law No. 42 of 2023). This is often faster than court proceedings for stopping counterfeit goods at market level.
- Persistent follow-up: each file was followed through inspection to decision.
The outcome
Successful decisions before the Ministry, fines imposed on the traders dealing in counterfeit goods, and a clear message to the market that the brand’s rights are actively enforced. We thank Mouaz Al-Khatib for his dedication and congratulate our client on the results.
